Among many successful arguments in Federal Court proceedings, the attorneys at Robertson, Johnson, Miller & Williamson secured an award in excess of $2.5 million in a complex litigation case for its client Prologis in an original $370,560 extended-lease agreement dispute with IGT, Inc. (Case No. 3:11-cv-00346-HDM-WGC; U.S. District Court of Nevada). The United States District Court of Nevada also awarded Prologis all attorneys’ fees and costs in the three-year litigation.
The original industrial large storage-space lease agreement was amended with an early termination clause when Prologis assumed the contract. IGT soon expressed its intention to exercise its option to vacate the contract early on the property in Nevada. Because the occupant did not meet its obligations before the deadline to complete the transaction, and failed to proffer the agreed upon early opt-out payment, the federal matter was heard in the U.S. District Court of Nevada.
